Standard Terms and Conditions of Hire

We understand the needs of our customers. When we commit to a client, not only do we put our reputation at stake but also risk the image of our clients, therefore, our aim is to indulge our clients and their guests with our unbeatable world-class transportation services.

  1. Bahamas Executive Car Hire (referred as the Company) undertakes to hire vehicle(s) to the Client (the person booking and paying for the service) for the period of hire, under the following terms and conditions: Prospective clients may use this website to complete an online quotation request form or make contact by telephone for a quick quote. We will respond to either request by email or telephone as appropriate, giving a quote based on the information provided. As required, we will negotiate and agree a price for the work the prospective client wants us to perform for them. We will then agree to a payment method (sending an email confirmation if requested).
  2. The terms and conditions set out herein shall apply to the ground transportation service agreement (the ‘contract’) and is entered into by the party whose name and address are set out in the booking confirmation and/or invoice (the ‘customer’) and Bahamas Executive Car Hire (the ‘service provider’) and shall apply to the provision of any and all passenger carriage, courier or delivery service (the ‘services’) undertaken during the continuance of this agreement.
  3. Nothing contained in these terms and conditions can affect the Client’s’ statutory rights.
  4. We reserve the right to amend, change, delete or add to these terms and conditions whenever we deem it necessary.
  5. All business between clients and Bahamas Executive Car Hire is a transaction based on the terms and conditions defined here (on this website). When any client places an order the assumption, therefore, is that the client agrees to all the terms and conditions defined here (on this website).
  6. By placing an order through our website, phone, or via email, you agree that you are legally capable of entering into binding contracts and you are at least over 18 years old.
  7. By providing us with your contact details, email, telephone and address we commit to never pass on your details to any third parties.
  8. As part of its Quality Assurance Programme, Bahamas Executive Care Hire will always wish to be transparent in the conduct of its business. Accordingly, we have tried to ensure our Terms and Conditions are presented in an easy-to-understand format. Please note these Terms and Conditions are to be read in conjunction with your Quotation. Payment of your deposit confirms your acceptance of the quotation provided and the accompanying Terms and Conditions.
  9. The quotation sets out the total number of hours for which the vehicle is contracted to you. Should your use of the vehicle exceed the total number of contracted hours, the excess is charged in multiples of 30 minutes at the Additional Hourly Rate specified on your quotation. For the avoidance of doubt, a 20-minute overrun will be charged at 30 minutes. If additional hours are likely to be incurred, failure or refusal to pay the additional charges may well result in the hire being terminated with immediate effect.
  10. An enquiry DOES NOT constitute a booking until confirmed by Bahamas Executive Car Hire.
  11. Bookings are confirmed and secured by a credit card facility only.
  12. Please note, any bookings for within 24 hours are not accepted through the online booking system so please contact the office direct for this.
  13. All our bookings are pre-paid, and our services are provided under our terms and conditions set out Please read these terms before placing a reservation.
  14. Wherever possible, we require at least 24 hours’ notice to secure a booking. At short notice please phone us for availability, we will try to help wherever we can.
  15. For all bookings (excluding wedding-related bookings) cancellations or amendments must be made and acknowledged by Bahamas Executive Car Hire 8 hours before the scheduled pick-up time. Otherwise, Bahamas Executive Car Hire reserves the right to charge the client for the full amount. This also applies to bookings that are made within 8 hours of the pickup time.
  16. Bahamas Executive Car Hire reservation team will make every effort to assist their clients 24/7. We will strive to always exceed all expectations, but 24 hours’ notice may be required to prepare the chauffeured vehicle for your specific journey. All prices quoted are in Bahamian dollars, with hiring starting at the pickup point (A) and finishing at the drop off point ( B ).
  17. To obtain a quote or make a booking through our booking agents, you are required to provide us full contact details, full name, contact number, and email address. Failing to do so, Bahamas Executive Car Hire will not be able to assist you any further.
  18. All bookings scheduled between 22:00 pm – 05:00 am are subject to 50% additional charges from online prices.
  19. Unless special arrangements are requested, the hourly booking begins from the time booked. Thereafter, waiting time charges will apply at our current standard rate.
  20. A standard day of the term “day rate” of any and every vehicle is 8 hours, with a minimum hire time of 5 hours, unless otherwise agreed. Even if the vehicle is returned within the 5 hours, the full 5-hour rate is due.
  21. If the customer fails to show at the designated location for which a reservation has been made and a confirmation was sent out, all monies paid will be non-refundable.
  22. The day prior to your journey or 2 hours before scheduled pick up time, our office team will email you full chauffeur’s and vehicle details. Our chauffeur will notify you directly when he is at the pick-up point, ready to assist and drive you to your destination in style.
  23. Drivers are NOT able to take future bookings and contact numbers are only available on the date of the hire. All future bookings should be made directly with Bahamas Executive Car Hire on our online booking form, by email or by calling the office telephone number. Bahamas Executive Car Hire will not accept any responsibility or liability for bookings made with a driver and passengers.
  24. Bookings booked from airports, and seaports the onus is on the passenger to locate the driver not the driver to locate the passenger. On booking any such journey we will advise a definite pick-up point that the passenger must locate.
  25. Any failure on the passenger’s part to locate the driver will result in a charge to the passenger’s credit/debit card or invoice submitted. Passengers failing to show up 1 hour after the confirmed arrival time will be charged for the transfer and parking costs if they do not inform us of delays at customs or immigration by telephone.
  26. We are happy to stop for comfort breaks of 10 minutes or less. Longer stops, such as for meals will be charged extra at our waiting time rate. If advised at time of booking this service will be included in the agreed rate.
  27. All charges specified herein, and in the current tariff published by the Company, are payable in advance except for where the client has a credit account or a credit card pre-approved by Bahamas Executive Car Hire. The credit or debit card you provide when making the booking will be charged for any additional charges e.g., extra waiting time, parking charges.
  28. Credit or debit card payments have no surcharge. However, credit card charges are non-refundable for booking cancellations.
  29. Rates are subject to change at any time without prior written notice.
  30. Credit Card payments are NOT subject to a surcharge.
  31. The charge on your credit card statement will be listed as Celebrity Transfers and concierge Bahamas.
  32. We honor the following credit card facilities. Visa, Master Card, Diner.
  33. Any variations to the journey(s) originally discussed, booked, and agreed to between the Company and the Client may be subject to additional charges, if these changes involve extra time and/or distance being covered.
  34. No hidden taxes, fees or extra charges will be payable upon completion of the job, except where additional waiting time and/or car parking charges have been incurred.
  35. When a prospective client wishes to proceed based on the quotation given and the payment method agreed, they will make their reservation using our online booking form.
  36. Credit Card payments must be authorized by the cardholder named in the booking. We withhold the right to cancel your booking without prior notice if we reasonably suspect that you or the cardholder are associated with any kind of fraudulent activity. Such suspicion may be based on the following activities:
  37. You cannot provide, when questioned, information about the itinerary such as full pick up and destination addresses, full passenger name and contact number, or any other mandatory requirements by the company.
  38. You cannot provide when questioned, contact information for the cardholder so that we may carry out security checks.
  39. The cardholder did not authorize the payment and claims that the booking is fraudulent.
  40. There have been previous fraudulent activity/chargebacks by you or the cardholder.
  41. Information given while booking is erroneous/ inadequate/ inconsistent/ linked to fraudulent behavior.
  42. There have been multiple payment attempts with inconsistent data entered.
  43. If we reasonably suspect that you or the cardholder are associated with any kind of fraudulent activity, we reserve full rights to refuse any bookings and we may report you or the cardholder to the fraud department.
  44. Your payment is not transferrable. It applies specifically to the vehicle requested for the date and times of contracted hire and for the destinations specified.
  45. When a vehicle is hired for two days or longer period, whilst every endeavour will be made for the hirer to retain the same vehicle and a chauffeur/driver during such a period, the Company reserve the right to substitute any other vehicle or chauffeur/driver according to the exigencies of the service.
  46. Our chauffeurs will drive at reasonable speeds according to their judgment of the prevalent road conditions and traffic at any time. When a hirer desires to travel to a particular place, the driver will, unless specifically otherwise instructed, travel by the route which is, in the chauffeur’s opinion, the best and most convenient for motoring, whether the route is the shortest or not, and no allowance will be made to the hirer on the ground that the route adopted is not actually the shortest. Or – ‘unless a specific route is requested at the time of hiring.’
  47. We reserve the right to substitute any vehicle or chauffeur/driver.
  48. The Company maintains a strict non-smoking policy in all its vehicles.
  49. We reserve the right to switch vehicles before a run based on availability without prior notice, if a vehicle that was previously requested is unavailable or if there is a risk of a driver not making it on time for a pick-up.
  50. We will guarantee the category chosen by you but not the make, specs, or color of the vehicle.
  51. If the interior or exterior of the vehicle is soiled or damaged by the customer, a valeting or repair charge will apply to the credit or debit card provided at the time of booking. Refusing to pay for the damage caused, legal action will be taken.
  52. Any damage caused to any part of our vehicle(s) by the passenger(s) will be charged accordingly.
  53. Please note: In the event of vehicles break down, punctures, or accidents – we will do our best to finish the journey with another fellow chauffeur but will not guarantee the arrival time.
  54. Bahamas Executive Car Hire reserves the right to provide alternative vehicle(s) to carry out the hire in case of mechanical breakdown or other unforeseen problems arising such as (but not limited to) delayed flight returns. Although every effort will be made to provide an equally suitable vehicle, Bahamas Executive Car Hire reserves the right to sub-contract other vehicles where required. We will ensure they are vetted and meet our own high standards where possible.
  55. We may over the course of a booking provide the client with a subcontracted vehicle, which will in turn have been assessed by Bahamas Executive Car Hire for its road worthiness and ensure all relevant documentation is present and the vehicle is fit for purpose.
  56. Vehicles will only carry up to the number of passengers which the vehicle manufacturer states and the booker has designated and agreed with the company. We will not carry more passengers than we are legally permitted to do so.
  57. We reserve the right to change the vehicle during the job if it is replaced for a similar vehicle and does not inconvenience the client unless prior agreement.
  58. Please note: Under no circumstances will we allow anyone other than the Chauffeur contracted to you to drive the vehicle or occupy the driver’s seat, not even for photography.
  59. Our vehicles are kept in pristine condition and serviced in accordance with the manufacturer’s instructions. The Company cannot accept liability for unforeseen circumstances including but not limited to mechanical breakdowns, accident, punctures, severe traffic or weather conditions or any other event, the act of God perceived to be outside of the control of Bahamas Executive Car Hire.
  60. In the unlikely event of a mechanical breakdown rendering the vehicle unsafe to drive or immobilizing the vehicle, we will use reasonable endeavors to either replace the vehicle for a similar vehicle from our fleet or at the very least provide alternative transportation.
  61. A comprehensive damage inspection of both the interior and exterior of the vehicle is undertaken prior to the vehicle leaving our premises and on its return. The details of these inspections are recorded on a damage inspection sheet.
  62. A reasonable amount of ordinary passenger luggage is allowed, but luggage which, in the opinion of the chauffeur amounts to an excessive weight will not be carried. Or ‘We reserve the right to refuse to carry luggage, which in the opinion of the chauffeur, is excessively bulky or heavy’.
  63. Bahamas Executive Car Hire accepts no responsibility for any loss or damage to any luggage or property carried in or on the car unless the loss or damage because of negligence by Bahamas Executive Car Hire. In the event of the property being left in a vehicle, we will gladly organize the return of such items, if the client covers the postage cost. Or – ‘subject to the client paying the reasonable costs of returning the items.
  64. Luggage will under no circumstance be allowed or permitted inside the seating area of the hired vehicle.
  65. We reserve the right not to carry any passenger(s) should the passenger(s) have excessive luggage that would result in the vehicle being overloaded and unsafe on the road and the driver’s decision is final. With the client’s agreement luggage van services will be engaged at the cost of the client. No refunds will be made in these circumstances.
  66. Our Cancellation Policy for bookings on all cars in our VIP fleet reflects their limited availability by making all deposits non-refundable. Once we accept your booking deposit payment, we refuse all and any other booking requests that could conflict with yours for that vehicle on that day.
    This no refund policy applies to all and any wedding car booking deposits and payments.
  67. A 50% deposit is required at the time of booking for any Wedding Car service.
  68. Please note:Payment of your deposit confirms that you are accepting the quotation provided and that you have received and accept the Terms and Conditions provided to you.
  69. Every effort will be made by the Company to ensure that vehicle(s) arrive on time and reach destinations on time too. The Company shall not be held responsible or liable for any delays (and/or arising consequential losses) that occur beyond its control.
  70. The Chauffeur will travel by the most appropriate route on the day, unless instructed otherwise by the Customer.
  71. For all wedding-related bookings 7 days, notice must be provided to cancel wedding bookings.
  72. If wedding cancellations are made within 7 days 50% of the booking fee will be charged.
  73. If wedding cancellations are made less than 48 hours of the booking date the full amount will be charged.
  74. Bahamas Executive Car Hire will make every effort to keep Wedding vehicles clean but during wet days and travel on city roads we are not always able to maintain the cleanliness of the exterior due to spray and mud and will not accept liability for marks/stains/dirt on clothing or wedding dresses. We may require time to clean the entrance/exit where possible.
  75. We understand that in the spirit of wedding festivities your party or associated parties may wish to be photographed in or around the vehicle. This is when damage is most likely to occur. We respectfully request that you inform all your guests not to touch/lean on the vehicle/s. Any photography in or around the vehicle must be approved by the Chauffeur prior to it taking place.
  76. Should any additional damage be noted as a direct result of any negligent or prohibited behavior, you as the Hirer will become liable for the cost of any repair and loss of business whilst the vehicle is being repaired.
  77. Our Chauffeurs are highly experienced and mature individuals who will always act with the greatest level of respect and discretion. Whilst in charge of the vehicle our Chauffeurs have complete authority to refuse any passenger, who by their behavior in the opinion of the Chauffeur (who will be the sole judge) presents a threat to the Chauffeur, the vehicle, other passengers, or road users.
  78. Our Chauffeurs reserve the right to terminate hire with immediate effect should any member of your party, or associated parties, display any behavior deemed to be unacceptable.
  79. The Hirer is responsible for any damage that they or their party, or any associated parties, may have caused, howsoever caused. Costs for such damage will be invoiced directly to the Hirer at actual cost plus 15%. Costs may also include for loss of earnings whilst the vehicle is being repaired.
  80. Decoration of the vehicle with ribbon must be undertaken by the Chauffeur only. If you wish to supply bespoke wedding ribbon, the Company will work with you to ensure a ribbon of acceptable quality from an approved manufacturer is selected. Poor quality ribbons have been known to create expensive damage to paintwork by leaking dye. Wedding ribbon of your choice WILL NOTbe fitted without prior approval.
  81. Please note: Under no circumstances will we allow anyone other than the Chauffeur contracted to you to drive the vehicle or occupy the driver’s seat, not even for photography.
  82. We reserve the right to refuse to carry any person that we consider is likely to be ill in the vehicle or who may behave in a way that endangers the occupants of the vehicle and/or the vehicle itself. In these circumstances no refund will be made. Should the vehicle require cleaning or valeting due to illness for any reason an immediate charge of $100 cash will apply.
  83. Any passenger who is thought to be under the influence of alcohol or drugs and whose behavior poses a threat to the driver, the vehicle, or other passengers may be refused travel.
  84. The hirer is responsible for the passengers. Passengers failing to return on time may be left behind, passengers affected by drunkenness or drugs may be refused permission to travel for the safety of the vehicle, other passengers and the driver’s decision is final. No refund will be available in these cases.
  85. Should a passenger breach Bahamian Law either by request to the driver, or against drivers will, the company will have no choice but to cancel the booking with immediate effect and Bahamas Executive Car Hire expect payment of 100% of the job value, regardless of how far into the job it is.
  86. Clients are responsible for all internal & external damage that has occurred whilst the vehicle is partaking in the clients’ job, unless of course the Chauffeur or a third party unrelated to the job is at fault. The Client will be billed accordingly for any repairs or valeting required in addition to any time lost to reinstate the vehicle to its previous condition.
  87. If upon first entry to the vehicle, the client spots any prior damage, they are to notify the Chauffeur immediately.
  88. Should any additional damage be noted as a direct result of any negligent or prohibited behavior, you as the Hirer will become liable for the cost of any repair and loss of business whilst the vehicle is being repaired.
  89. Our Chauffeurs are highly experienced and mature individuals who will always act with the greatest level of respect and discretion. Whilst in charge of the vehicle our Chauffeurs have complete authority to refuse any passenger, who by their behavior in the opinion of the Chauffeur (who will be the sole judge) presents a threat to the Chauffeur, the vehicle, other passengers, or road users.
  90. Our Chauffeurs reserve the right to terminate hire with immediate effect should any member of your party, or associated parties, display any behavior deemed to be unacceptable.
  91. Although vehicles are fully insured for passenger and third-party claims under Bahamian Law, client’s properties are carried entirely at their own risk and the Company shall not be held responsible/liable for any loss/damage to such property.
  92. Bahamas Executive Car Hire will not be held responsible for the safety or custody of personal belongings, purchases, luggage, or any other items carried by any passenger, or which are left in the vehicle. Lost property should be reported to Bahamas Executive Car Hire as soon as possible in case it can be returned.
  93. On conclusion of the hire, the vehicle is thoroughly checked and cleaned on its return. If there are any items found, you will be promptly notified, and your goods will be made available for collection. In the unfortunate event that items are reported but however not found within the vehicle, the Company cannot accept any responsibility or liability for the loss of any such items.
  94. The Company and its Chauffeurs have the right to refuse to carry any passenger who is thought to be under the influence of alcohol or drugs and whose behavior poses a threat either to the Chauffeur, the vehicle, or any other passenger. The full cost of repair of any damage caused by passengers to the hired vehicle(s), including spillages or sickness which require cleaning and valeting, will be charged to the Hirer.
  95. We have a zero-tolerance policy against harassment, discrimination, and rudeness either verbally or in writing against our employees and contractors. In such an event, we reserve full rights to withdraw our goods and services to consumers effective immediately. Full money paid for goods and services will not be refundable.
  96. Chauffeurs are responsible for the vehicle at all times and as such are not permitted to break any Bahamian Laws, including, and not limited to, speeding, smoking, drinking.
  97. Bahamas Executive Car Hire retains the right to change the chauffeur for any job at any point during the booking.
  98. Bahamas Executive Car Hire respects your right to privacy. We operate with absolute discretion and confidentiality. Our Chauffeurs are not permitted to take photos or request autographs, nor are they permitted to discuss the details of any assignment either prior to nor the following completion.
  99. Requests for child seats must be made at the time of booking. Only one child seat will be provided free of charge. Additional child seats are charged at $ 50.00 per seat. We will always aim to satisfy such requests but failure to do so will not constitute a breach of contract.
  100. If you wish to use your own child seat you will be responsible for installing it safely and removing it at your destination. Care must also be taken to not damage the vehicle interior with your child’s seat. Otherwise, you will be charged to compensate for this.
  101. All passengers must wear the seat belts provided in all vehicles. Bahamas Executive Car Hire accept no responsibility or liability for injuries, accidents, or death because of passengers failing to wear the seat belts provided. Child seats must be secured by the passengers providing them. Bahamas Executive Car Hire will not be responsible for the safety or fitting of child seats.
  102. On a private hire, no animals (other than guide dogs and hearing dogs) may be carried on any vehicle without prior written agreement from the company. Please note that additional costs will incur if traveling with animals.
  103. We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under a Contract that is caused by an Event beyond our control. An Event beyond Our Control is defined as any act or event beyond our reasonable control, including war, invasion, hostilities (whether war declared or not), civil war, revolution, rebellion, Storm, flood, earthquake, subsidence, epidemic, or other natural disasters, or failure of public or private telecommunications networks. Without limitation traffic delays, tire punctures, road traffic accidents, road closures due to accidents and vehicle breakdowns, strikes, and lockouts.
  104. If an Event beyond our control takes place that affects the performance of our obligations under a contract:
  105. We will contact you as soon as possible to notify you.
  106. Our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event beyond our control.
  107. In the event of awfully bad weather, we reserve the right to cancel without penalty if advised against travelling by authorities such as the Police or Met Office or if we consider it unlikely that we will be able to complete your journey safely. In these circumstances a full refund, less any credit card charges will be made but no further compensation is due.
  108. Every effort will be made by Bahamas Executive Car Hire and its drivers to get passengers to their destination on time or early. Passengers should check their collection times and enquire about any known delays to ensure they leave with enough time to complete the journey ahead and arrive on schedule.
  109. Whilst we will do our best to ensure we are punctual; we cannot be held accountable for circumstances out of our control.
  110. To ensure the safety of our Chauffeurs and maintain the highest quality standards that you our client has come to expect, smoking and the consumption of food in the vehicle is expressly forbidden.
  111. Consumption of beverages is permissible but strictly at the Hirers risk. Any spillages which require professional valeting will be charged to the Hirer accordingly.
  112. In the very unlikely event of a problem, complaint or dissatisfaction with our company’s services, the hirer should endeavor to seek a solution at the time by seeking assistance from the driver or from the company immediately. If this has not provided a remedy, complaints should be submitted in writing and within 14 days of the termination date of the hire. The Company will acknowledge all complaints within 14 days and will normally reply fully within 28 days.
  113. Please provide as much detail as you possibly can. We promise to investigate your complaint fully. Wherever possible we will report our findings back to you and the action taken.

  115. It is a condition of this agreement that invoices shall be paid in full within 30 days of issue thereof. Should an invoice not be paid within 30 days, any outstanding invoice(s) shall immediately become due and payable.
  116. Our credit terms are strictly 30 days from the date of invoice unless previously agreed otherwise for account holders.
  117. Without prejudice to the Company’s rights hereunder, all monies due to the company in respect of provision of the services which are not paid by the due date shall bear interest on the balance of such monies due at the rate of 8% per month.
  118. The customer shall not be entitled for any reason to withhold payment of monies due to Bahamas Executive Car Hire. The company reserves the right to enforce this late payment charge until payment is received in full by Bahamas Executive Car Hire in respect thereof.
  119. The content of our website, including but not limited to text, graphics, logos, software, and trademarks are the property of Bahamas Executive Car Hire and are protected by copyright and other laws. Bahamas Executive Car Hire does not tolerate copyright infringement and will actively pursue any known infringement to the full extent of the law.
